MEA Prevails on Certified Substitute ULP

The Marion Education Association announced today that the Public Employees Relations Commission (PERC) ruled in its favor on the longstanding Unfair Labor Practice it had filed over the hiring of substitute teachers rather than full-time teachers under the negotiated Collective Bargaining Agreement. This practice by the District also appeared to violate the local School Board’s own Policy 6.11 which parallels Florida Statutes by stating that “A substitute employee is a person who is called as needed.”

 

Yesterday’s ruling seeks to put closure on a practice dating back to 2008. PERC, in its remedy, ordered the district to cease and desist from:

 

  1. Hiring personnel in classifications entitled "substitute teacher," "continuous substitute teacher," or "certified substitute teacher" to fill vacant teaching positions and to fill the positions of teachers on leaves of absence but failing to afford those personnel the wages and other terms and conditions of employment provided for employees under the collective bargaining agreement between the School District and the Association.

 

  1. In any like or related manner interfere with, restrain, or coerce public employees in the exercise of any right guaranteed them under Chapter 447, Part II, Florida Statutes (2013).

 

The ruling also directs the district to reimburse the association for reasonable attorney fees and litigation costs for the successful prosecution of this charge.

 

“The real winners in this are the children of Marion County, all of whom deserve to have a full-time, highly qualified and certified professional educator in their classroom”, notes Chris Altobello, MEA President. “It is our hope that we can put this behind us and concentrate on the other pressing needs of our county.”
